Being convicted of an offense like drug transportation can result in serious ramifications. States like Florida, in particular, have a low tolerance for these types of crimes. There are strict rules surrounding substance possession, manufacturing, and trafficking.
Drug Trafficking Laws
Drug trafficking Florida statute § 893.135 states: It’s unlawful for a person to sell, purchase, manufacture, deliver, or bring drugs into Florida. However, Florida Statute § 893.13(5) separately states that it’s unlawful for a person to transport controlled substances from another state into Florida.
Offenses committed under these statutes differ from other laws concerning this conduct due to the amount of the controlled substance involved. For example, moving illegal substances could be charged as drug trafficking or drug possession with intent to sell depending on the quantity of illicit substances found.
Penalties
While the consequences of offenses like drug trafficking vary from case to case, there are some standard penalties provided by the state. For example, almost every trafficking charge is labeled a first-degree felony in Florida. Prison time and fines, however, are not as easily synthesized. Here are some common penalties for drug trafficking.
Cocaine Trafficking: 3-15 years in prison (30 years max). $50,000 – $250,000 in fines.
Weed/Cannabis Trafficking: 3-15 years in prison (30 years max). $25,000 – $200,000 in fines.
Heroin Trafficking: 3 years – life in prison. $50,000 – $500,000 in fines.
Oxycodone Trafficking: 3-25 years in prison. $50,000 – $250,000 in fines.
Methamphetamine (Crystal Meth) : 3-15 years in prison. $50,000 – $750,000 in fines.
